1. Agreement to these Terms
These Terms of Use ("Terms") are an agreement between you and PicoJoy Pte. Ltd. ("PicoJoy", "we", "us", or "our"). By accessing or using our games, websites, apps, mini-programs, player support, or related services (collectively, the "Services"), you agree to these Terms.
If you do not agree, do not use the Services. If you use the Services on behalf of a company or other organization, you confirm that you have authority to bind that organization.
2. Eligibility and accounts
- You must be at least 13 years old, or the minimum age required in your country or region, to use the Services unless a specific title is made available under a separate age-appropriate experience.
- If a game supports accounts, you are responsible for keeping your login credentials secure and for activity that occurs under your account.
- You must provide accurate information and keep it current where the Services ask for it.
- We may suspend or terminate access if we reasonably believe an account is used in violation of these Terms, platform rules, or applicable law.
3. Player conduct
You agree not to:
- Cheat, exploit bugs, use bots, scripts, unauthorized automation, modified clients, or other unfair methods.
- Reverse engineer, decompile, scrape, copy, resell, or interfere with the Services except where allowed by law.
- Harass, threaten, defame, impersonate, spam, or abuse other users, PicoJoy, platform providers, or support staff.
- Upload or share illegal, infringing, offensive, harmful, deceptive, or malicious content.
- Bypass payment systems, platform rules, security controls, age gates, geographic restrictions, or moderation systems.
- Use the Services for gambling, wagering, or real-money prize activity unless a specific product expressly supports it and all required approvals are in place.
4. Purchases, virtual items, and subscriptions
Some Services may offer paid content, in-app purchases, subscriptions, virtual currency, virtual items, ad removal, premium features, or other digital content. Purchases are processed by the relevant platform, such as Apple App Store, Google Play, WeChat, or another authorized store, and may also be subject to that platform's terms and refund rules.
- Virtual items and virtual currency are licensed, not sold. They have no cash value and cannot be redeemed for money unless required by law.
- Prices, availability, features, and virtual item balances may vary by region, platform, title, and version.
- We may change, rebalance, suspend, or discontinue virtual items or game features where reasonably necessary for gameplay, security, legal, or business reasons.
- Refund requests should generally be made through the store or payment platform that processed the purchase. You can also contact support if you need help locating the right channel.
If a title offers auto-renewing subscriptions, the subscription terms shown at purchase will apply, including price, renewal period, cancellation method, and trial details.
5. PicoJoy content and user content
The Services, including games, code, artwork, characters, logos, designs, text, audio, video, gameplay systems, and related materials, are owned by PicoJoy or our licensors and are protected by intellectual property laws.
If a Service lets you submit, upload, or share content, you retain your rights in that content. You grant PicoJoy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, distribute, and use that content as needed to operate, improve, moderate, and promote the Services. You must have all rights needed to submit the content.
We may remove or restrict content that we reasonably believe violates these Terms, platform rules, applicable law, or the rights or safety of others.
6. Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect information. By using the Services, you acknowledge our Privacy Policy.
7. Updates, availability, and third-party services
We may update, patch, rebalance, suspend, or discontinue all or part of the Services at any time. Some features may require an internet connection, compatible device, app store account, platform account, or third-party service.
The Services may include links to or integrations with third-party services such as app stores, social platforms, ad networks, analytics providers, login providers, payment processors, or cloud services. We are not responsible for third-party services, and their own terms and policies apply.
8. Disclaimers and limitation of liability
The Services are provided "as is" and "as available" to the maximum extent permitted by law. We do not promise that the Services will be uninterrupted, error-free, secure, compatible with every device, or available in every region.
To the maximum extent permitted by law, PicoJoy and its officers, employees, partners, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or use arising from or related to the Services or these Terms.
Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.
9. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PicoJoy from claims, damages, liabilities, losses, and expenses arising from your misuse of the Services, your content, your breach of these Terms, or your violation of law or third-party rights.
10. Termination
You may stop using the Services at any time. We may suspend or terminate access to the Services, accounts, or features if we reasonably believe you violated these Terms, created risk for PicoJoy or other users, or if required by law or platform policy.
11. Governing law
These Terms are governed by the laws of Singapore, without regard to conflict of law principles, unless local consumer law requires otherwise. Courts in Singapore will have non-exclusive jurisdiction, subject to any mandatory rights you may have in your country or region.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide additional notice where required. Your continued use of the Services after the updated Terms take effect means you accept the updated Terms.
